If you wish to handle or deal with explosive substances in the commercial sector and already have a permit for the same activities in accordance with Section 21 of the Weapons Act, you do not require a permit in accordance with the Explosives Act.
You are also exempt from the permit requirement under § 7 SprengG if you have neither a domicile or permanent residence nor a branch in Germany and wish to import, export, carry out or transfer explosive substances to Germany. The prerequisite is that the transportation is accompanied by a holder of a certificate of competence in accordance with § 20 SprengG or by a person who has been commissioned in writing by the federal government or a federal state to accompany you.
An application for exemption from the permit requirement is not necessary. The exemption comes into force by law.
In order to obtain an exemption for the commercial handling and transportation of explosive substances, you must meet the following requirements:
- 1. possibility of exemption:
You have a firearms license in accordance with § 21 of the Weapons Act, with which the same handling and traffic is permitted as under § 7 of the Explosives Act.
- 2nd possibility:
You have neither a domicile or permanent residence nor a place of business in Germany and wish to import, export, carry out or transfer explosive substances to Germany. The transportation is accompanied by a holder of a certificate of competence in accordance with § 20 SprengG or by a person who has been commissioned in writing by the federal or state government to accompany you.
Exemption from the permit requirement according to § 7 SprengG
- 1st possibility:
A permit for the same facts is available under the Weapons Act
- 2nd possibility:
Persons who import, export, carry out or transfer explosive substances and are not resident in Germany
The exemption is not issued in writing. It is granted by law.
