- Persons married to each other may also be able to design their name by declaring to a German registry office even after their marriage abroad.
- The registry office issues a certificate of this.
Spouses can design their own naming.
The following declarations of name apply, provided that the German Staff Regulations apply to the spouses:
- Marriage name determination (even after marriage)
- Acceptance of an accompanying name (pre-appointment or addition)
- Re-acceptance of the birth name
The corresponding declaration must be made to the registry office and must be personal.
Furthermore, the explanatory person must be able to do business, the provisions of Section 106 of the German Civil Code (BGB) apply to limited business able to do business, and section 119ff of the German Civil Code (BGB) applies to persons in charge.
Declarations made after marriage must always be certified by the public.
Declarations of names are declarations of intent requiring receipt of official reception and only become effective after receipt from the competent German registry office.
If there is no German marriage or marriage entry for the receipt of a declaration of naming in the marriage, in whose jurisdiction one of the denoting or last had his domicile or his habitual residence is domiciled. If such a domestic reference exists, this jurisdiction shall apply if the marriage has been concluded abroad and has not yet been re-certified in a German marriage register. If such a domestic reference, in the form of a residence or habitual residence in Germany does not exist, the registry office 1 in Berlin is responsible.
The registry office issues a certificate of the declaration of the name.
- Identity document (identity card or passport)
- Marriage certificate, or certified extract from the marriage register
- with translation, apostille and, if necessary, verification of content. (To be determined in detail by the competent registry office).
- The declarants must be married to each other.
- The corresponding declaration must be made to the registry office.
- Declarations relating to marriage names must be made in person.
- The declaration can only be made by persons with legal capacity.
- The declaration must be publicly notarized.
- There may be costs for the names.

In Mecklenburg-Western Pomerania, the following costs apply:
- Certification or certification of a declaration, consent or consent to the naming of spouses 30 Euro
