If municipalities are obliged to bear costs (e.g. for footpaths) as part of a road construction project of the state road construction administration, this share is eligible for funding. This also applies to the municipal share of the costs of intersection measures between municipal roads and federal or state roads. - Railroad crossing measures
When constructing a new crossing or modifying an existing crossing in accordance with the Railway Crossings Act, the statutory share of the costs attributable to the party responsible for the road in accordance with crossing legislation is eligible for funding.

Who is eligible for funding?
- Beneficiaries can be municipalities, districts or municipal associations that are responsible for the construction instead of municipalities or districts.
How is funding provided?
The grant is awarded as project funding by way of pro rata financing as a non-repayable subsidy of up to 75% of the eligible expenditure. Grants are rounded down to the nearest 100 euros. Grants of less than EUR 10,000 should not be approved.
Eligible expenditure includes all expenditure required to make the project operational and safe for traffic and in line with the state of the art. In the case of land acquisition, only the initial costs are eligible for funding.
In particular, the following expenses are not eligible for funding
- Expenditure which a party other than the project sponsor is obliged to bear,
- Administrative expenses, unless they are measures under the Railway Crossing Act,
- expenditure on the acquisition of land and parts of land, including buildings, which are not directly or permanently required for the project,
- Value added tax amounts that the project sponsor can deduct as input tax in accordance with Section 15 of the Value Added Tax Act,
- planning costs and
- financing costs.
The completed application must be accompanied by the following documents:
- A description of the content of the project, stating that the nature and scope of the project is urgently required to improve traffic conditions and that the requirements under point 4 are met or will be met at the latest at the time of funding,
- Extract from the traffic plan or equivalent plan,
- Overview map 1 : 10,000 with colored entry of the project, if necessary divided into functional construction sections, including any sections of the overall construction project that are already in progress or have been completed,
- Road cross-section showing the existing and planned condition,
- Estimate of expenditure or simplified calculation of expenditure,
- planned implementation schedule.
In particular, eligibility requirements are that
- the project is planned in a structurally and traffic-technically sound manner and in compliance with the principle of economic efficiency and economy,
- the project takes into account the needs of people with disabilities and other people with mobility impairments and meets the requirements of accessibility as far as possible,
- the project fulfills the requirements of approval and building law,
- the project is included in the funding program for municipal road construction,
- the project has not yet been started. The start of the project is generally deemed to be the conclusion of an execution and service contract attributable to the execution; planning, soil investigation and land acquisition are not deemed to be the start of the project,
- no grants under Section 5a of the Federal Trunk Roads Act or Section 17 of the Railway Crossings Act are being or have been applied for or granted for the project (special cumulation prohibition); otherwise, a combination with funds from other funding sources is permissible and subject to prior agreement.
Application procedure
This is a two-stage application procedure. Stage 1 involves registering the project for inclusion in the funding program and determining the basic eligibility of the project for funding. After inclusion in the funding program, stage 2 involves applying for approval of the funding.
Stage 1: Application for inclusion in the funding program
In order to be included in the funding program, which is updated annually, a project should be registered in writing by the funding recipient five years in advance, if possible, but no later than 31 January of the year preceding the planned start of construction, with a view to medium-term financial planning. Only the standard form (Annex 1) may be used for the application.
The completed application must be accompanied by the following documents
- A description of the content of the project, stating that the nature and scope of the project is urgently required to improve traffic conditions and that the requirements under point 4 are met or will be met at the latest at the time of funding,
- Overview map 1 : 10,000 with a colored entry of the project, if necessary divided into functional construction sections, including any sections of the overall construction project that are already in progress or have been completed,
- Road cross-section showing the existing and planned condition,
- Estimate of expenditure or simplified calculation of expenditure,
- planned implementation schedule.
The application may be omitted if an application has already been submitted in accordance with section 7.2.2. The approval authority will check the documents for completeness and for basic eligibility for funding in accordance with these administrative regulations and will issue a review report on the inclusion of the project in the funding program.
The funding recipient will be informed in writing by the approval authority of the inclusion or non-inclusion of the project in the program, the expected funding rate and the expected approval period as well as the annual amounts planned for the program period by means of the review note. However, this notification does not constitute a commitment or a legal entitlement to a grant. With the same notification, the grant recipient is requested to inform the funding authority immediately of any significant changes or additions, in particular with regard to the start of construction, construction periods, expenditure, financing or planning, and to submit an application for funding in good time.
Stage 2: Application for a grant
A written application by the grant recipient is required for the grant to be approved. The application must be submitted to the competent granting authority by July 31 of the year preceding the planned start of the measure using the template in Annex 2, including the documents listed therein. In particular, the following documents must be attached
- Construction design in accordance with the applicable design guidelines (Guidelines for the design of uniform design documents in road construction - RE 2012). For projects that can be designed without detailed design documents, a simplified design is sufficient.
- Information on the preparation of the project, in particular on the status of land acquisition and the willingness of third parties to participate (e.g. through administrative agreements under the Railway Crossings Act), as well as coordination results for projects that are connected to other urban development and traffic measures.
- Financing plan in accordance with the model in Annex 2a to show the overall financing and the calculation of eligible expenditure.
- Declaration that the project has not yet begun and will not begin before the grant is approved or the early start of the measure is authorized.
- Declaration in accordance with the template in Annex 2b that the project takes into account the needs of people with disabilities and other people with mobility impairments and meets the accessibility requirements as far as possible.
- Declaration as to whether the municipal body is entitled to deduct input tax in accordance with Section 15 of the German Value Added Tax Act. If this is the case, the resulting benefits must be shown in the financing plan.
- Current data evaluation for the assessment of long-term performance from the "computer-aided budget assessment and information system for local authorities - RUBIKON".
The ministry responsible for transport or the granting authority may request further documents. The approval authority will check the application for completeness in accordance with the generally recognized rules of construction technology from a technical and economic point of view as well as the eligibility of the expenditure for funding and will set out the result in a review report. The necessity and appropriateness of the grant must be justified.
For projects with eligible expenditure in excess of EUR 2.5 million, the approval authority submits the audited application and the audit opinion to the Ministry responsible for transport.
Approval procedure
The approval authorities are the local road construction authorities.
On the basis of the funding program confirmed by the Ministry responsible for transport, the approval authority issues a grant notification, the receipt of which must be confirmed by the grant recipient (Annex 3). As a general rule, work on the measure may not commence before the grant has been approved. In individual cases, the ministry responsible for transport may approve an informal application for early commencement of construction.
