The intervention regulation according to §§ 13ff. BNatSchG aims to maintain the performance and functionality of the ecosystem and the landscape, even outside of special conservation areas. The most common types of intervention include the construction of settlements and transportation routes. Interventions in nature and the landscape are to be avoided as a matter of priority according to the impact regulation under nature conservation law. If this is not possible, landscape conservation measures (so-called compensation and replacement measures) must be taken. With this procedure, a comprehensive approach is taken to all protected natural resources and the landscape. The avoidance requirement, the polluter pays principle and the impact management principle of the impact regulation are of fundamental importance for achieving the objectives of nature conservation and landscape management in general, but also for achieving the objectives of Section 1 BNatSchG in particular (cf. special explanatory memorandum to Sections 13 et seq. BNatSchG as amended). The integrative and, in conflict situations, mediating approach within the impact regulation will also be decisive for the long-term existence and sustainable development of biodiversity. In addition, the quality of the implementation of the impact regulation depends on the underlying impact forecasts.
