Abandoned and free-roaming animals are considered lost property and must be reported to the owner, the owner or the competent authority. The duty to report is deemed to have been fulfilled when the lost and found animal is handed in at the responsible animal shelter.
From a purely legal point of view, found pets and domestic animals are lost property. Lost and found animals are all lost pets, i.e. animals that are usually kept by humans, such as dogs, cats, ornamental birds or agricultural animals. Wild animals are not pets. If you have found a lost dog or other animal, you must report the find to the responsible municipality as lost property authority. In case of doubt, the municipality decides whether the animal is a domestic or a wild animal and is then responsible for the appropriate housing of the animal.
As a rule, the municipalities cooperate with local animal shelters, where the found animals are accommodated. Animal shelters provide the species-appropriate housing required by the Animal Welfare Act, care and nutrition as well as necessary veterinary treatment for the animals.
If free-roaming animals endanger public safety, especially traffic safety, you should immediately notify the police (emergency number 110).
If you have found a wild animal in need of help, please contact the emergency control centers (call 112). They will then inform the responsible authorities.
If you have found a pet, contact your local authority. You can report the find there and also hand in the animal by arrangement. The municipality, as the lost property authority, will then take care of the further accommodation and care of the animal.
Many municipalities have commissioned an animal shelter with the safekeeping of lost and found animals. The municipality can inform you about the assigned animal shelter, e.g. by telephone, Internet or notice board. If the municipality cooperates with an animal shelter, which takes over the accommodation and care of lost and found animals for them, you can usually also hand in the animal directly there. In this case, the animal shelter will take care of the lost property report.
After reporting the lost and found to the lost and found authorities, you can also keep the animal yourself with the approval of the lost and found authorities. However, this does not affect the fact that the loser remains the owner, so that the animal may have to be surrendered if the owner of the animal can be determined or comes forward himself.
