Where the competent road traffic authority has prohibited or restricted motor traffic in accordance with road traffic legislation on certain roads or in certain areas where motor vehicle traffic contributes to the exceeding of immission values laid down in regulations and where the authority responsible for pollution protection considers it necessary in the light of local conditions in order to reduce or prevent harmful environmental effects from air pollution. , it may allow exceptions to prohibitions or restrictions on motor vehicle traffic where there are undisputable and overriding reasons for the public good. The thirty-fifth ordinance for the implementation of the Federal Immission Protection Act, adopted as a legal regulation, regulates exemptions from traffic prohibitions and the assignment of categories M and N vehicles to pollutant groups and determines requirements to be met when vehicles are identified.
With the introduction of the "Ordinance for the Implementation of the Federal Immission Protection Act" the establishment of environmental zones in German cities was made possible. The aim of the regulation is to reduce the increasing nitrogen oxide and particulate matter pollution in urban areas. With the entry into force of the law in 2007, vehicles will only be allowed to enter the designated environmental zones with the appropriate pollutant group. In Mecklenburg-Vorpommern no environmental zones are designated.
Various EU emission protection directives (see Appendix 2 of the 35th BImSchV) define the requirements of vehicles of categories M and N to comply with. Depending on which limits for nitrogen oxide and particulate matter the vehicle's exhaust gas management complies with, four groups of pollutants are defined, three groups (2 to 4) of which are marked by stickers (plaques). For labelling, non-reusable light-fast and forgery-aggravated plaques with, inter alia, a badge diameter of 80 mm and in the colours red, yellow and green shall be used. Compliance with the conditions of the relevant directive must be demonstrated to the issuing agency by means of the emission key numbers of the motor vehicle. To this end, the Federal Minister for Transport and Digital Infrastructure has published an assignment of the key numbers to the pollutant groups in the traffic bulletin (VKBl. 2006 p. 867) and the "Publication of the provisions of the Ordinance on the Adoption and Amendment of Regulations on the Labelling of Low-Emission Vehicles" (VkBl. 2007 p. 3). For older vehicle licences issued before 1 October 2005, the emission key numbers are the last two digits under box '1' and, for newer registration certificates issued after 1 October 2005, the last two digits under box '14.1'.
In the case of vehicle documents issued before 1 October 2005: the vehicle registration certificate
In the case of vehicle documents issued after 1 October 2005: the Part I registration certificate or The Part II registration certificate
In the case of motor vehicles or combinations of vehicles intended or used for road haulage, the total permissible weight of which is not less than 7.5 tonnes and which are registered abroad, proof of the emission class shall be provided by presentation of the current vehicle tax notice or a valid proof (vehicle licence or registration certificate, Part I).
The limit values for nitrogen oxide and particulate matter defined in various emission protection EU directives are complied with by the exhaust gas management system of the vehicle for which a marking of assignment to a pollutant group is requested.
The marking of motor vehicles of classes M and N according to their allocation to pollutant groups is subject to a fee. Based on the schedule of fees for road traffic measures, 5 euros can be collected by the registration authorities in Mecklenburg-Western Pomerania for issuing a sticker. The amount of the fees depends on the administrative expense. Costs for expert opinions or other expenses are not included in the fees.
de.xoev.schemata.xzufi._2_2_0.StringLocalized@3a31733aIf the vehicle's exhaust management system complies with the defined limit values for nitrogen oxide and particulate matter, the responsible issuing office will enter the license plate number of the respective vehicle in the space provided on the sticker using a lightfast pen and, after payment of the costs, will give the completed sticker to the owner, the person authorized to dispose of the vehicle, or the authorized representative. To identify the motor vehicle, the sticker shall be clearly visible on the inside of the windshield. The sticker must be made and affixed in such a way that it self-destructs when detached from the windshield.
Excluded from the obligation to identify vehicles and thus also from restrictions on the use of environmental zones are:
- mobile machines and devices
- Machinery
- two- and three-wheeled vehicles (e..B mopeds, motorcycles, scooters). This includes light four-wheeled vehicles (quads)
- Agricultural and forestry tractors (tractors, etc.)
- Vehicles used to drive or drive persons who are exceptionally disabled, helpless or blind (proof by mark "aG", "H" or "Bl" in the severely disabled card)
- Ambulances, doctor's trolleys with appropriate markings in use (e.B. "Doctor emergency operation")
- Vehicles for which special rights can be claimed in accordance with Section 35 of the StVO
- Vehicles of non-German troops in the context of military cooperation
- civilian vehicles on behalf of the Bundeswehr for inexcplaceable journeys for the performance of public functions.
Exceptions other than those mentioned above may be requested from the Road Traffic Authority, which issued the traffic authority order. The competent road authority shall consult the Environmental Protection Agency, which has requested the traffic authority order, before granting an exemption.
Since March 1, 2007, the 35th BImSchV has been valid for motor vehicles. It regulates exemptions from traffic bans and the assignment of motor vehicles to groups of pollutants and lays down requirements to be met when vehicles are identified.
In Mecklenburg-Western Pomerania, environmental badges are issued both by the registration authorities and by the bodies recognized for carrying out exhaust emission tests, such as the officially recognized experts or inspectors or test engineers at test centers of the Technical Inspection Agency or the officially recognized monitoring organizations, or by the personnel responsible for carrying out the exhaust emission test in the motor vehicle workshops recognized for this purpose by a notice of recognition from the ten locally and professionally responsible motor vehicle guilds in the designated operating facilities or branch offices.
