A municipality establishes a development plan as a statute (local law).
With the development plan, the municipality defines the boundaries of the spatial area of application and which uses are permitted on a certain municipal area. In addition, the type and extent of building use are determined. The legally binding stipulations must be observed by all citizens.
In addition to the graphic representation (plan drawing), the actual plan, the justification and the summary declaration belong to every development plan. The explanatory memorandum explains the urban development objectives and purposes pursued with the development plan, whereas the summary statement explains how the environmental concerns and the results of the public and authority participation have been taken into account in the planning. In addition, it contains the justification for the draft selected from several alternatives. The development plan and the summary statement can be inspected by anyone (§ 10 (3) and (4) BauGB).
