For the protection of road users, the legislator has stipulated that seat belts must be worn while driving and that protective helmets must be worn when driving motorcycles. However, within extremely narrow limits, it is possible to be exempted from this obligation upon application. The resulting considerable safety risk is borne by the applicant.

You can be exempted from the obligation to wear a seat belt if

• it is not possible to wear seat belts for health reasons , or
• the body height is less than 150 cm.

You can be exempted from the obligation to wear a helmet only if

• it is not possible to wear a safety helmet for health reasons and
• the use of another means of transport is disproportionate.

The exemption is revocable and usually granted for a limited period of time, unless it is a certified/documented permanent condition.

The exemption from the obligation to wear seat belts is only permitted if persons

1) the wearing of seat belts is not possible for health reasons, or

2) the body height is less than 150 cm

The costs for a decision on a permit in accordance with the Road Traffic Regulations (StVO) amount to between 10.20 and 767.00 euros plus further expenses in accordance with the Fee Regulations for Road Traffic Measures (GebOSt), depending on the administrative effort and economic benefit.

The exemption from the obligation to wear a seat belt must be applied for at the responsible road traffic authority.

According to the Road Traffic Regulations (StVO), the wearing of prescribed seat belts is mandatory.

The road traffic authorities may approve exceptions to the regulations on the use of seat belts in justified individual cases.
