Within the framework of youth welfare, mothers and fathers are entitled to counseling on partnership issues if they are responsible for or actually care for a child or adolescent. The counseling is intended to help build up a life together as partners in the family, to overcome conflicts and crises in the family, and, in the case of separation or divorce, to create the conditions for the exercise of parental responsibility in a way that is conducive to the well-being of the child or adolescent. In the case of separation and divorce, parents shall be supported in the development of a mutually agreeable concept for the exercise of parental care and parental responsibility with the appropriate participation of the child or adolescent concerned; this concept may also serve as the basis for a settlement or a court decision in family court proceedings.
The counseling service is aimed at all mothers and fathers who have or actually have to care for a child or young person.
It can be used by eligible fathers and mothers on a voluntary basis and free of charge.
de.xoev.schemata.xzufi._2_2_0.StringLocalized@555220aaBy advising on issues of partnership, separation and divorce (Section 17 SGB VIII), the legislator defines an offer to promote education in the family as a regular task for youth welfare, thus marking the relevance of counselling for the safeguarding of family relationships and the strengthening of parental responsibility.
The advice can be initiated by the participation of the Youth Office in proceedings before the family courts (Section 50 SGB VIII). The advice is subject to confidentiality and social data protection.
