When a property is divided, a part of the property is written off in the land register and registered as an independent property.
Special cases
The division of the property must be authorised by the municipality or expropriation authority if your property isproperty:
- in a reallocation area,
- Redevelopment area or urban development area or
- is affected by expropriation proceedings that have been initiated.
Tip: If you have questions for the lower building law authority, you shouldthe property, such as the district, parcel and plot number. You can obtain these from the lower surveying authority.
- Identity card or passport
- Extract from the property register with the new parcel boundaries
- in the special cases mentioned: authorisation of the division of the property, if applicable
You have had the new boundaries surveyed (surveying order).
By dividing a property that has been built on or whose development has been authorised, you may not create any conditions that conflict with building regulations. Above all, you must observe the distance regulations. If necessary, you must apply to the relevant building authority for a deviation, exception or exemption.
By dividing a property within the scope of a development plan, you may not create any conditions that contradict the provisions of the development plan.
In the special cases mentioned, the division of the property must be authorised by the municipality, reallocation office or expropriation authority.
You must notify the municipality or district office two weeks in advance of the division of a plot of land.
- for surveying: fees in accordance with the Fees Ordinance in conjunction with the Schedule of Fees. The amount of the fee depends on
- on the number of parcels to be created,
- the number of boundary points and
- the standard land value.
- for entries in the land register: fees, depending on the respective transaction value.
To have the division of the property entered in the land register, you must submit a declaration to the relevant office.
