Upon application, a business can be continued without a representative for up to one year after the death of the trader.
After the death of a trader, the trade may be continued for the account of
- the surviving spouse or partner,
- the minor heir during his/her minority, or
- the administrator of the estate, executor of the estate or executor of the will
as a rule only be operated by an authorized representative in accordance with Section 45 of the German Commercial Code.
Upon application, the competent authority may permit the trade to be operated without a deputy for a period of one year after the death of the trader.
This does not affect special regulations that exist for individual trades (e.g. crafts, hospitality).
Fees are charged in accordance with the state ordinance on administrative fees. Information on this can be obtained from the responsible office.
