Anyone wishing to run a guardianship association generally requires state recognition.

If you want to run a care association whose employees provide people with care and legal representation on the basis of a court order, you need state recognition.

An association with legal capacity can be recognized as a care association if it guarantees that it

• has a sufficient number of suitable employees and will supervise, train and adequately insure them against any damage they may cause to others in the course of their work,
• makes planned efforts to recruit volunteer guardians, introduces them to their tasks, provides them with further training and advises them and authorized representatives,
• provides information on powers of attorney and care orders as planned and
• facilitate an exchange of experience between employees.

In addition, the association must be managed by persons who are not in a relationship of dependency or any other close relationship with an institution in which people cared for by the association or members of the association are accommodated.

Recognition applies to the respective country; it can be limited to individual parts of the country. It is revocable and can be granted subject to conditions.

The following documents must be attached to the application:

• Articles of association,
• proof of insurance,
• certificate of non-profit status,
• proof of the number, training and professional background or other qualifications of the full-time employees.
