Certain building documents require the signature of an author of the design (e.g. an architect).
In accordance with Section 65 (1) of the State Building Code for Schleswig-Holstein (LBO), building documents for the construction and alteration of buildings that do not require a procedure must be signed by a design author who is authorized to submit building documents; in accordance with Section 54 LBO, this requires the necessary expertise and experience to prepare the respective building project.
Pursuant to § 65 Para. 2 LBO, anyone who is authorized to submit building plans on the basis of
- the Chamber of Architects and Engineers Act (ArchIngKG) is entitled to use the professional title "architect" or "architect",
- is entered in the list of engineers authorized to submit building documents in accordance with Section 9 (1) of the ArchIngKG or whose work as an external engineer meets the requirements of Section 9a of the ArchIngKG,
- is entitled to use the professional title of "interior architect" in accordance with the ArchIngKG for the planning tasks belonging to the professional duties of the interior architect in accordance with Section 1 (1) No. 2 of the ArchIngKG or
- of the ArchIngKG is entitled to use the professional title "landscape architect" or "landscape architect" for the planning belonging to the professional tasks of the landscape architect in accordance with § 1 Para. 1 No. 3 of the ArchIngKG.
In accordance with Section 65 (1) LBO, the aforementioned restrictions do not apply to building documents that are usually drawn up by specialists with training other than that specified in Section 65 (3) to (5) LBO or for minor or technically simple construction projects.
§ Section 65 (3) LBO contains regulations for the limited authorization to submit building documents with regard to residential buildings in building class 1 as well as subordinate single-storey extensions to existing residential buildings in building classes 1 to 3. Section 65 (4) regulates the authorization to submit building documents for companies.
The aforementioned drafters in accordance with Section 65 (3) and (4) LBO must have sufficient professional indemnity insurance or other liability insurance for their activities (Section 65 (6) LBO).
