Pflanzenschutzmittel: Nicht zugelassenes Einsatzgebiet - Genehmigung

Anyone wishing to use plant protection products in an area of application other than that specified in the authorization requires a permit.

Plant protection products may only be used if they are authorized. The competent authority may, on application, authorize the use of an authorized plant protection product in an area of application other than that specified in the authorization in individual cases if

• the application is intended
  • on plants that are only cultivated on a small scale, or
  • against harmful organisms that only cause significant damage in certain areas and
• the intended use corresponds to that in an area of application specified in the authorization.

The authorization must be combined with the necessary conditions to protect human and animal health and to protect against other harmful effects, in particular on the ecosystem.

Before issuing the permit, the competent state authority must obtain an opinion from the Federal Office of Consumer Protection and Food Safety.

Every decision on an application, including a rejection, is subject to a fee in accordance with the Schleswig-Holstein State Ordinance on Administrative Fees for Plant Protection Matters (individual approval EUR 50.00).

As a rule, approval is limited to three years and is subject to revocation.

It should also be noted that a permit for the use of a plant protection product on plants and plant products from which food can be obtained may only be granted if the expected residues are covered by a maximum quantity in the Maximum Residue Quantity Ordinance and the food obtained only contributes to a minor extent to the average daily consumption quantity.
