Gaststättenbetrieb: Erteilung einer vorübergehenden Erlaubnis / Gestattung

Anyone wishing to open a restaurant for a short period of time (e.g. as part of a public festival) requires a temporary permit.

Do you intend to open a restaurant (e.g. food truck, beer tent) at short notice during a special event (e.g. public festival, music event)? A temporary restaurant license (permit) allows this under simplified conditions. However, the special reason must not lie solely in the gastronomic activity itself.

This permit is only necessary if you are operating a restaurant that requires a permit. You do not need the permit if you only serve

• non-alcoholic drinks,
• free samples,
• prepared food or
• in connection with an accommodation establishment, drinks and prepared food to house guests.

Permission can only be granted for a specific location. For example, the place where your permitted beer tent may be located is specified in the permit. Irrespective of the permission to operate a restaurant, you will generally require a permit to set up a tent/van and similar. If the event takes place indoors, building regulations may need to be observed.

The responsible office decides on the necessary documents on a case-by-case basis.

Currently, administrative fees of EUR 50.00 are charged in accordance with the Annex to the State Ordinance on Administrative Fees.
A maximum fee of up to EUR 1,000.00 is permissible in individual cases where there is an increased need for inspection or processing. Detailed information on this can be obtained from the responsible office.
