If you wish to provide legal services in the following areas, you must register with the competent authority:
- Debt collection services,
- Pension advice in the field of pension advice, in the field of statutory pension and accident insurance, social compensation law, other social insurance and disability law relating to a statutory pension as well as occupational and occupational pension schemes.
- Legal services in a foreign law; if the foreign law is the law of a member state of the European Union or another state party to the Agreement on the European Economic Area, advice may also be provided in the field of European Union law and the law of the European Economic Area.
Prerequisites:
You must be personally suitable and reliable. Important criteria for the required reliability are previous experience (in particular any criminal offenses) and financial circumstances. Furthermore, you need proof of special expertise (theoretical and practical) in the relevant areas of law. Natural and legal persons as well as companies without legal personality can be registered. The application can be limited to one or more of the following sub-areas of legal services in a foreign law: "intellectual property law" and "tax law".
If necessary for the protection of legal practitioners or legal transactions, registration may be made subject to conditions or linked to requirements.
Legal services in connection with another activity are permitted without registration in the legal services register if they are an ancillary service of the profession or activity. Legal services provided in connection with one of the following activities are deemed to be permitted ancillary services:
- Execution of wills,
- property and housing management,
- subsidy advice.
- Summary of professional training and previous professional experience,
- Certificate of good conduct in accordance with § 30 Para. 5 of the Federal Central Register Act,
- Declaration as to whether insolvency proceedings are pending or whether an entry has been made in a debtor register (Section 26 (2) of the Insolvency Code, Section 915 of the Code of Civil Procedure) in the three years prior to the application,
- Declaration as to whether registration or admission to the bar has been denied, withdrawn or revoked in the last three years prior to the application and - if this is the case - a copy of the decision,
- Documents proving theoretical and practical expertise,
- proof of professional liability insurance.
In accordance with the Legal Services Act (RDG), a fee of EUR 150.00 (plus expenses, if applicable) is charged for registration.
Anyone who is legally established in another member state of the European Union or in another state party to the Agreement on the European Economic Area (EEA) for the purpose of practicing a profession associated with the provision of legal services may, under certain conditions, practice this profession temporarily and occasionally in Germany.
