Foundations can be set up for a wide variety of reasons, for example out of personal concern or in memory of a loved one.

There are almost 800 foundations with legal capacity under civil law in Schleswig-Holstein. Foundations are created for a wide variety of motives and motivations: social obligation, personal concern, in memory of a loved one or in the interest of a good cause.

In thefoundation deed, the founder determines the name, location and purpose of the foundation and undertakes to endow it with assets (usually cash, securities or real estate), the income from which is used to finance the foundation's work. Afoundation charter, also specified by the founder, regulates the internal organization.

The foundation acquires its legal capacity through state recognition. For foundations that are to have their registered office in Schleswig-Holstein, the foundation deed and articles of association must be submitted to the Ministry of the Interior, Municipal Affairs, Housing and Building of the State of Schleswig-Holstein. It is recommended to contact this authority before submitting the final application. Recognition of the foundation will be granted if the requirements under foundation law are met.

Thefoundation supervisory authority (the foundation supervisory authority is the district/city in which the foundation is based) ensures that the foundations are administered in accordance with the law, the foundation deed and the foundation statutes. It ensures that the will of the founder is permanently adhered to or not changed more than necessary.

• A fee of between 200.00 euros and 7,500.00 euros is charged for the recognition of non-charitable foundations.
