Maintenance refers to the expenses required to meet a person's living expenses. Essentially, a distinction is made between child maintenance and spousal maintenance.
Child maintenance:
If a parent who lives separately looks after a minor child, they generally fulfill their maintenance obligation by bringing up and caring for the child. The other parent owes cash maintenance.
There is a so-called increased maintenance obligation towards underage children. This means that the parent liable for cash maintenance must do everything reasonable to ensure the child's maintenance. The amount of cash maintenance is calculated according to the Düsseldorf table. The decisive factors here are the income of the person liable to pay maintenance and the age of the child.
Adult children are only entitled to maintenance if they are in education or are not fully available to the labor market due to illness and are therefore unable to support themselves.
If no or no regular maintenance can be obtained from the debtor, children of single parents up to the age of 18 can receive maintenance from the maintenance advance fund. One of the prerequisites for this is that the children over the age of twelve are not dependent on SGB II benefits or that their single parent earns at least 600 euros while receiving SGB II benefits.
Spousal maintenance:
If a spouse is unable to support themselves after separation or divorce, they are entitled to maintenance from the other spouse under certain conditions.
