The excavation certificate gives the construction company permission to carry out the construction project on the land concerned.

With the excavation certificate, the construction company receives the approval of the road authority to carry out the construction project on its land. The road owner registers the construction project and thus has the opportunity to check the proper restoration during or after completion of the construction work and after the end of the warranty period.

Each excavation changes the condition and quality of the traffic area. The coordination of excavations is important in order to minimize subsequent costs for the general public and the client of the excavation must be known in order to establish warranty claims.

More legal certainty is created for all parties involved, as the excavation site is documented, from which the rights and obligations of the parties involved can be derived.

Excavations in public traffic areas are therefore generally subject to approval.

The excavation certificate must be kept ready by the company carrying out the work at the work site for inspection purposes.

Exception: laying or changing telecommunications lines. According to § 68 TKG, no excavation permit is required for this, only the consent of the road construction authority (from 01.12.2021: § 127 TKG). Operating and maintenance work is not subject to approval, as this work is covered by the approval granted for the installation.

Corresponding usage agreements may also have to be concluded when laying cables on roads.

The local civil engineering office requires an application for approval of an excavation and, if necessary, a section of the site plan.

The LBV-SH requires different documents depending on where the excavation is to be carried out. It is therefore recommended that you contact the LBV-SH in this regard.

The use of traffic routes for telecommunications lines that serve public purposes is free of charge.

In accordance with § 223 Para. 4 TKG, only fees and expenses covering administrative costs may be charged for the issuing of approval notices.

The excavation certificate must be applied for by the company carrying out the excavation at least 14 days before the start of the excavation at the local civil engineering office or at another competent authority (e.g. LBV-SH).

In the case of applications for approval in accordance with § 127 TKG, the deadlines contained therein must be observed.

The excavation certificate does not replace other necessary permits, such as a traffic order.

To the civil engineering office of your municipal, local or city administration or

to the Landesbetrieb Straßenbau und Verkehr Schleswig-Holstein (LBV-SH) for the roads in its area of responsibility:

• Federal trunk roads and state roads outside the local thoroughfare (OD),
• Federal trunk roads within the OD with a population of less than 80,000 inhabitants,
• within the OD for state roads with a population of less than 20,000 inhabitants,
• for district roads according to contract administration in the districts of Dithmarschen, Nordfriesland, Stormarn, Ostholstein, Plön, Rendsburg-Eckernförde and Schleswig-Flensburg.

The excavation permit can be applied for informally at the local civil engineering office.
