If you want to transfer your fishing rights completely to someone else, you must conclude a fishing lease agreement with this person and have it approved.
If you wish to transfer your fishing rights in full to another person, you can lease them to them. To do this, you conclude a fishing lease agreement with the tenant. You submit this lease agreement to the supreme fisheries authority for approval. The contract becomes effective upon approval. If you make a change to a fishing lease agreement, you must also submit this to the supreme fisheries authority for approval. If you terminate the contract, it is sufficient to notify the authority. If you do not submit the lease for approval, the contract may not be effective. This means that the contract only becomes fully effective when you submit it to the supreme fishing authority and it approves the contract.
- Fishing lease
- Fishing license of the tenant
- Map of the body of water
- If applicable, extract from the land register regarding ownership of the body of water
- In the case of independent fishing rights: extract from the land register or details of the relevant fishing book and serial number
Approval for your fishing lease will be granted if:
- you have drawn up the contract in writing,
- the lease term is at least 12 years,
- the tenant holds a fishing license,
- and if approval can be granted in accordance with § 12 Para. 2
After you have concluded or amended a fishing lease,
- send it together with the required documents by post to the higher fisheries authority and ask for approval of the contract.
- If any documents are missing from the application, the authority will let you know and you can send them later.
- The authority will now check whether the requirements for approval have been met and will inform you of this in an approval notice.
If approved, the contract is now fully effective.
Objection:
If the authority does not grant the permit, it will send you a rejection notice. In this case, you can lodge an appeal. How to do this is described in your notification.
