• § Section 10 (7) of the Municipal Tax Act (KAG),
• State ordinance on recognition as a spa or health resort (KurortVO),
• Definitions - Quality standards for the classification of health resorts, resorts and spas, published by the German Tourism Association and the German Spas Association (DHV),
• Law on store opening hours (Shop Opening Hours Act - LÖffZG),
• State ordinance on the sale of certain goods on Sundays and public holidays in spa, recreation and excursion destinations (LadSchlV SH).

As soon as a municipality has been recognized as a spa resort, it may levy a spa and tourist tax.

Municipalities or parts of municipalities can be recognized as a spa or resort if they meet the requirements of the state ordinance on recognition as a spa or resort (KurortVO).
There are the following designations for health resorts:

• Heilbad,
• Sea spa,
• seaside spa,
• Kneipp spa,
• Kneipp health resort,
• climatic health resort and
• climatic health resort.

In exceptional cases, two awards can also be granted.

Recognition entitles the municipality to levy spa taxes and ongoing tourist taxes.
In addition, special regulations on store opening hours apply to health resorts and resorts.

Documents proving that the requirements for the respective rating have been met.

As soon as the municipality/parts of the municipality are recognized as a spa or resort, a repeat assessment of the air and climate quality is required every 10 years.
