§6 and §7 Saarland Education Leave Act (SBFG)
If you offer events for political or professional further education or further education in voluntary work, you can apply for recognition as an educational event if you meet the requirements.
According to the Saarland Education Leave Act, employees are entitled to time off work to take part in an educational measure that is eligible for time off for professional or political further training and further training to carry out voluntary work or work for the common good that is voluntary and unpaid. The event must be recognized by the responsible ministry as eligible for exemption.
If you offer an educational measure for this target group, you can submit an application for recognition of the educational event.
The recognition procedure in accordance with Saarland educational leave law offers a number of simplifying options for the recognition of events:
1. by submitting a formal application for each individual event. The application must be accompanied by the program of the educational measure.
2. if the educational measure has already been recognized in another federal state, it is also eligible for exemption in Saarland, provided that 5 hours of instruction per day are achieved. The notice of recognition from the other federal state must be accompanied by the equality information, which you can download here.
3. educational institutions that provide evidence of quality management in accordance with EN ISO 9000 ff. or comparable standards may be authorized to issue exemption certificates themselves in accordance with the Saarland Education Exemption Act. This requires the submission of a copy of the certification. The procedure is informal.
The state and state-recognized German universities and their institutions as well as the recognized universities from member states of the European Union do not require a QM certificate and are considered authorized to issue exemption certificates. They will receive a letter of confirmation with further instructions on request.
The following documents are required to apply for initial recognition of an educational event under the SBFG:

The following documents are required for the recognition of an educational event that has already been recognized in other federal states:

- Recognition notice from the other federal state
- Track position information according to SBFG
Events for political or professional further training or further training in voluntary work can be certified as eligible for exemption if
- these are open to all employees,
- participation is optional,
- the personnel, material and spatial conditions allow the achievement of the intended learning success to be expected,
- the daily work program is not less than five hours,
- the information on plans, costs, event management, topic, content, work and time schedule, childcare options, certificate, examinations, necessary prior knowledge and all other essential conditions of participation are made available,
- the training organizer and the events do not pursue any objectives that are contrary to fundamental rights or the constitution.
The competent ministry will determine eligibility for exemption within four weeks of receipt of the complete application. (§7 SBFG)
You must submit the complete application for exemption to the responsible ministry at least 6 weeks before the start of the event.
