If you wish to employ a pregnant or breastfeeding woman between 8 p.m. and 10 p.m., you must obtain authorisation from the supervisory authority responsible for maternity protection.
The competent supervisory authority may refuse or temporarily prohibit you from employing the pregnant or breastfeeding woman during this period in order to ensure the protection of the health of the woman or her child.
If the supervisory authority does not refuse or temporarily prohibit employment, you may employ the woman between 8 p.m. and 10 p.m. subject to the requirements of the Maternity Protection Act.
Note: This does not replace the notification of employment of a pregnant or breastfeeding woman in accordance with Section 27 of the Maternity Protection Act. Please use the form available for this purpose.

Note: For companies that are subject to mining supervision, the Saxon Mining Authority is the supervisory authority responsible for the implementation of maternity protection monitoring.

- Declaration of consent from the pregnant or breastfeeding woman. The woman can revoke her declaration at any time.
- Assessment of working conditions in accordance with the Maternity Protection Act
- Statement on working alone
- The pregnant or breastfeeding woman must expressly declare her willingness to work between 8 pm and 10 pm
- A medical certificate must not speak against working until 10 pm.
- There is no irresponsible risk to the pregnant woman and the child from working alone.
- The documented assessment of the working conditions shows that there are no other irresponsible hazards.
You can apply for authorisation in writing using the application form provided (-> Forms and further offers).
- Send your application to the competent supervisory authority (-> competent authority), including the required documents and evidence.
- If the documents or information required for processing are incomplete, you will be contacted immediately by the processing department.
- The competent office will check the documents.
- Your application will be deemed approved if you do not receive a rejection within six weeks.
- If the requirements for approval are not met, you will receive a rejection - this can also be provisional.
- If your application is rejected, you will receive a notice of rejection.
- Upon request, the employer must be notified of the fictitious authorisation.
