- §§ 2 und 4 Gesetz über den öffentlichen Gesundheitsdienst im Freistaat Sachsen (SächsGDG)
The locally responsible health authority can grant you access to the death certificate or provide information from it if
- you can credibly demonstrate a legitimate interest in knowing the circumstances of the death of a named deceased person and there is no reason to assume that the disclosure would jeopardise the interests of the deceased or their surviving dependants that are worthy of protection.
- universities or other departments involved in scientific research require the information for a scientific project and if the scientific interest in carrying out the research project outweighs the interests of the deceased or their surviving dependants.
A legitimate interest can always be assumed if the applicant could be influenced in his legal position or his claims against third parties with regard to an immediate deterioration or improvement by not being informed of the circumstances of death.
Every deceased person undergoes a medical post-mortem examination after death. The death certificate documents the post-mortem examination. It contains a non-confidential and a confidential part.
The application must be accompanied by
- Identity card of the applicant (replaced by eID for online applications)
- Death certificate of the deceased person
- Proof of credible interest, for example
- Proof of relationship (e.g. family register, family documents corresponding to the family relationship)
- Health care proxy or certificate (proof of authorisation to care for the deceased)
- Birth certificate or certificate of parentage
- Marriage or civil partnership certificate
- Will
- Release from the duty of confidentiality of the beneficiary of the insurance policy
- Proof of the deceased's consent to the transfer of data for scientific studies
- You have a legitimate interest in finding out more about the death of a person.
- As a university or scientific institution, you have the consent of the deceased person to find out more about their death as part of a scientific study.
