Permission under aviation law / exemption from prohibited use of airspace in accordance with Section 19 of the German Air Traffic Regulations (LuftVO)
If you would like to launch children's balloons or fireworks within a radius of 1.5 kilometers of an airfield at an anniversary or event celebration, you will require a permit or exemption under aviation law. The same applies to flying kites and operating spotlights or lasers.
In addition to the location, the height of the ascent and the number of balloons are also decisive.
Note: The ascent of so-called sky lanterns is generally prohibited in the Free State of Saxony.
An informal application or the same notification that must be submitted to the public order office for a fireworks display is required with the following details
- exact display/operation location,
- date, time,
- height of ascent or discharge,
- responsible operator or, in the case of fireworks, pyrotechnician,
The consent of the landowner must be submitted with the application.
- Applications can only be submitted for ascent locations within Germany.
- The consent of the landowner must be obtained.
- Depending on the number and ascent altitude, a so-called air traffic control clearance must be obtained from the responsible air traffic control center when using controlled airspace (see -> Detailed information).
Air traffic control clearance is not required and is deemed to have been granted if:
- fewer than 500 balloons are released
- the balloons are not bundled together (so-called balloon clusters)
- no flammable gas (helium) is used for inflation
- no hard objects (wood, plastic, metal, sparklers, glow sticks, glow sticks, LEDs) are attached to or in the balloons.
Fireworks
Either submit an informal application for an air permit or send the responsible authority the same notification that you submitted to the public order office for a fireworks display.
Application review and decision
The cresponsible department will check the application and, if necessary, obtain further information or opinions for the granting of an exemption permit.
Once the application has been successfully reviewed, you will receive a decision, which is subject to a fee.
The launching of category F2 fireworks (in the period from 02.01. to 30.12.) as well as categories F3, F4, P2 and T2 or at a distance of less than 1.5 km from the boundary of airfields requires permission from the state aviation authority.
The commercial use of pyrotechnics of category F2 must be reported to the public order office in accordance with the Ordinance to the Explosives Act (1st SprengV); for private use you require an exemption permit under explosives law.
