As responsible person or processor, you are obliged under the General Data Protection Regulation (GDPR) to provide the contact details of the designated data protection officer to the competent supervisory authority. You can submit the notification to the Saxon Data Protection and Transparency Officer online.
With regard to data protection, the Data Protection and Transparency Officer is responsible for
- non-public bodies (e.g. companies, associations, private foundations) with headquarters in Saxony
- public bodies (e.g. Saxon state and local authorities, hospitals, police stations, savings banks, chambers of commerce, notary's offices)
According to the General Data Protection Regulation (GDPR/DSGVO), you are obliged to appoint a data protection officer. This applies
- to every public body in accordance with Article 37(1)(a) GDPR
- for the above-mentioned non-public bodies if at least one of the requirements applies in accordance with
- Article 37(1)(b) or (c) GDPR or
- § Section 38(1) of the Federal Data Protection Act (BDSG)
Provide the contact details of the designated data protection officer to the Saxon Data Protection and Transparency Officer in writing. Use the online form for your notification (see -> Online application); this is the only way to receive confirmation of receipt.
Note: Notifications by e-mail, post or fax will of course not be rejected, but your online notification will save the responsible body an enormous amount of bureaucratic work.
The following information is mandatory:
- Type of notification: initial notification, change notification, cancellation notification and date
- Contact details of the body responsible for notification: name, street, house number, postcode, town (optional: telephone number, e-mail address, URL of homepage)
- Notifier: Name (optional: function, telephone number, e-mail address)
- Data protection officer: Surname, first name, street, house number, postcode, city, telephone number (optional: e-mail address)
- Specification of internal data protection officer (with indication of other functions) or external data protection officer (with indication of company)
Once this information has been provided, the controller and processor have fulfilled the requirements of Article 37(7) GDPR.
Your notification will be stored electronically by the Saxon Data Protection and Transparency Officer until you notify a change or cancellation of the appointment of the data protection officer. The SDTB uses the data of the designated data protection officer for its own purposes, for example to contact your data protection officer in accordance with Article 39(1)(e) GDPR.
