Would you like to erect and operate a marquee or a fairground ride? For so-called temporary structures, you generally need a licence from the local building supervisory authority before you are allowed to start operating them.
Temporary structures are non-stationary structures that are repeatedly erected and dismantled, such as fairground rides and marquees. The commissioning of temporary structures with a construction licence can be made dependent on an acceptance of use by the local building supervisory authority. For the commissioning of technically difficult temporary structures, as well as grandstands and/or tents with a floor area of more than 75 m², you always require a user approval from the local building inspectorate. Roller coasters and looping rides, fast-moving or innovative carousels, somersaults and giant swings as well as giant rides with more than 14 gondolas are to be categorised as technically difficult temporary structures. You will need the inspection book with the construction licence for the acceptance test.
During the acceptance test, it is checked whether
- the construction complies with the building documents
- an implementation licence is available and its provisions are complied with
- the stability at the installation site is ensured by bracing, ballasting or anchoring
The acceptance test can be limited to random samples. The result of the acceptance test is noted in the inspection logbook.
- Application form
- Test book of the temporary construction with integrated execution licence
The prerequisite for acceptance for use is met if the temporary structure
- has an inspection logbook with a valid construction licence
- the inspection logbook was submitted to the locally responsible lower building supervisory authority for inspection in good time
- was erected in good time and this was notified
Notification, acceptance of use
The erection of a temporary structure must be notified in good time to the locally responsible building supervisory authority, submitting the inspection book and the information required for acceptance regarding the respective site (such as location, size, topography/surface conditions; extinguishing water supply, including access roads, entrances and emergency exits, if applicable) and - if necessary - supplementary plans (such as overview, site and sub-pallation plans for sloping terrain). The notification must also state when the temporary structure is ready for acceptance. Temporary structures must be erected in good time so that the acceptance of use can be carried out before commissioning. In the case of special or technically difficult temporary structures (e.g. large grandstands, roller coasters, etc.) or if an inspection of the system technology is required in individual cases, experts may also be called in. In particular, the following must be checked during the acceptance test
- the validity of the inspection logbook
- the conformity of the temporary structure with the construction documents and compliance with the ancillary provisions of the construction licence
- the safe erection of the temporary structure with regard to the ground conditions on site
- the proper routing and labelling of escape routes, especially in tents with more than 400 visitor seats.
The acceptance of use may be limited to spot checks. The building supervisory authority should give the authorities or bodies whose area of responsibility is affected the opportunity to take part in the inspection (fire protection authority, public order office, trade supervisory authority and employers' liability insurance association) and the result of the inspection must be entered in the inspection logbook.
Depending on the scope of the test documents (test book) and the size of the flying construction.
