Changes to a monument, such as damage, sale or change of use, must be reported immediately to the relevant monument protection authority.
Reasons for notification exist if
- the use of your cultural monument changes,
- Damage and defects occur to the cultural monument that jeopardise its preservation or
- You sell your cultural monument.
Damage is an impairment of the cultural monument that has already occurred. This includes, for example
- a leaking roof,
- detached gutters or downpipes,
- defective windows and doors,
- damaged fencing,
- fallen parts or even
- Cracks in movable monuments such as works of art.
The object is defective if damage is likely to occur, for example due to loose parts, a decrepit or faulty construction, flaking paint or non-functioning alarm systems (in the case of collections).
A change in the previous use of cultural monuments concerns the general abandonment of the use of the monument or relates only to certain parts of a monument. If the change of use involves structural alterations, repairs or modernisation, approval is generally required. The provisions of building law remain unaffected. If a building permit is required for your project, this replaces the authorisation under monument protection law. The responsible building supervisory authority obtains the approval of the monument protection authority as part of the authorisation procedure.
If a cultural monument is sold, the seller and buyer must notify the change of ownership within one month. If you inherit a monument, you must also do this.
You must submit documents that the authority requires to assess your project. These can be
- Documentation of the damage (expert opinion, photographs),
- Name and address of the purchaser (in case of sale),
- possibly a power of attorney or declaration of consent from the owner
The cultural monument is in your ownership or possession or you are authorised by this person to report it.
Depending on the regulations of the respective authority, you can submit your notification in writing or online (see -> Online application).
Online notification
- Log in to the service account. If you do not yet have a service account, set one up under "Register free service account".
- Click on the button under Online application.
- Fill in the data fields according to the instructions and upload your supporting documents. You can save the details temporarily at any time and complete them at a later date. You can find cached versions under "My online applications" in your service account.
- Once you have completed all the data fields, you can finalise the application. The data will be sent to the relevant office.
- You will find confirmation of receipt in the inbox of your service account. You will receive a notification of incoming messages to your personal e-mail address.
Written notification
- If a notification form is available, you can obtain this via Amt24 or via the authority's own website.
- Submit the completed and signed notification form or the informal letter with the required supporting documents to the competent authority. You can send the documents electronically by e-mail.
- The authority will check the notification and confirm receipt.
