Application for notification as an inspection body for biowaste in accordance with the Biowaste Ordinance in waste management
If you act as a centre for the testing of biowaste in accordance with the Biowaste Ordinance, you must be notified in advance.
Biowaste handlers are obliged to analyse the biowaste for certain parameters and hygienic safety.
If you wish to carry out these inspections, you must apply to the competent authority of the federal state to designate you as an inspection centre. The notification or designation applies to the entire federal territory.

- Valid accreditation certificate in accordance with DIN EN ISO/IEC 17025 including the annex to the certificate and the accreditation decision of the Deutsche Akkreditierungsstelle GmbH (DAkkS) as well as reports on the last corresponding assessment including any deviation reports,
- Declaration of consent on the transfer of information between the countries and the accreditation body (see Part 1 Number 1.3.1, Waste module/ Status: May 2023)
- Current (not older than two years) certificate of successful participation in the round robin test for the determination of parameters in accordance with the Biowaste Ordinance
- Insurance policy for property damage liability insurance appropriate to the risk
- Copy of the authorisation to work with pathogens in accordance with Section 44 of the Infection Protection Act (InfSchG), if required for the requested testing task
- Current partnership agreement with details of the natural or legal persons authorised to represent the company and a current extract from the commercial register,
- List of internal and external samplers, contract between the inspection body and the sampler and the date of the last internal and external audit of the sampler.
Note: An external sampler is a person who is not or not permanently employed by the laboratory and who is contractually integrated into the laboratory's quality management system. This person may be employed by another employer or work on a freelance basis.

Evidence from other EU/EEC contracting states
- When examining the application for notification in accordance with theBioAbfV, certificates from another member state of the European Union or another signatory state to the Agreement on the European Economic Area are treated as equivalent to certificates from Germany if they show that you as the applicant fulfil the relevant requirements for expertise, independence, reliability and technical equipment.
- Submit the certificates with your application in the original or as a copy; the competent authority may require the copy to be notarised and a certified German translation.
- You submit your application in Saxony if you have your registered office in Saxony or if you primarily want to carry out your activity in Saxony (if you have your registered office abroad).

- carry out quality assurance and quality control measures, including regular successful participation in round robin tests.
You submit an informal application for notification as an inspection centre for biowaste to the authority of the federal state in which you have your registered office. If your place of business is abroad, submit the application in the federal state in which you will primarily carry out your inspection activities.
Proceed as follows:
- Create the informal application and enclose the required documents. If necessary, the competent authority will request further application documents.
- If you wish to enclose equivalent recognition and evidence from another member state of the European Union or another signatory state to the Agreement on the European Economic Area with the application, these documents must be submitted before commencing work.
- The competent authority may request a certified German translation of foreign equivalent recognition and evidence.
- After examination by the competent body, you will receive a written decision as to whether you will be notified as an examination and investigation centre.
- The competent body may attach a reservation of revocation, a time limit, conditions, requirements and the reservation of conditions to the notification.
- Time limit of the notice: maximum 5 years. You will find detailed information on the time limit in your notification.
- Application for extension of the time limit: at the latest 4 months before the expiry of the still valid notice

- The notice is published in the ReSyMeSa research system for measuring bodies and experts under the Waste module.
