Authorisation and notification in accordance with the Chemicals Prohibition Ordinance (ChemVerbotsV)

If you wish to place certain substances and mixtures on the market in accordance with the Chemicals Prohibition Ordinance (ChemVerbotsV), you require a licence from the competent authority. This applies to the manufacture, introduction, trade and provision to third parties.

If you supply the substances and mixtures exclusively to resellers, professional users and public research, testing and teaching institutions, a licence is not required. Notify the authority in writing of the first supply or provision before you start the activity.

The substances and mixtures concerned can be found in Annex 2 of the Chemicals Prohibition Ordinance (see Legal basis).

Erforderliche Unterlagen

  • Specification of the product range and the named responsible persons (see Requirements)
  • Proof of expertise; proof of further training if applicable
  • Certificate of good conduct (document type 0, not older than 6 months) (Führungszeugnis)
  • current copy of the trade licence or extract from the commercial register (Handelsregisterauszug)
  • Identity card (copy)

Voraussetzungen

  • Proof of expertise in accordance with Section 11 (1) of the Chemicals Prohibition Ordinance (ChemVerbotsV)
  • required reliability
  • Minimum age of 18 years

Proof of the required expertise

  • passed examination by the competent authority / an institution recognised by this authority in accordance with Section 11 (2) ChemVerbotsV
  • other qualifications in accordance with Section 11 (3) ChemVerbotsV

Note: In the Free State of Saxony, the examination is carried out by the State Directorate of Saxony or by a recognized institution.

Expertise must be regularly renewed through appropriate further training events:

  • every 6 years (one-day training course)
  • alternatively every 3 years (half-day training course) (see § 11 Paragraph 1 No. 2 ChemVerbotsV).

Further requirements

  • For each dispensing point (main establishment, branch), nomination of at least one person employed in the establishment who fulfils the above requirements
  • in the case of supply to resellers, professional users or public research, testing or teaching institutions: if applicable, appointment of persons in accordance with Section 8 (2) ChemVerbotsV

Kosten

  • for the licence: EUR 70.00 to 1,000
  • for the notification: none

Verfahrensablauf

The application for authorisation or notification in accordance with the Chemicals Prohibition Ordinance (ChemVerbotsV) must be submitted in writing to the competent authority. Use the form provided (see Online application and forms).

  • Specify the product range and the named responsible persons (see Requirements).
  • Compile the necessary supporting documents.
  • Submit the completed and signed application documents to the competent body.

The competent authority will check your documents and confirm the notification in writing. You will receive a written notification of authorisation.

Notifying changes

Notify the competent authority immediately of any changes to the designated persons or the final assignment in the same way.
