Applying for an exemption from basic obligations and protective measures for the commercial handling of hazardous substances

If you wish to deviate from the provisions of the Hazardous Substances Ordinance (GefStoffV), you must apply for an exemption from the competent authority.

In order to obtain the exemption authorisation, you must be able to prove that the measure or project you are concerned with corresponds to the protection objective of the Hazardous Substances Ordinance. For example, you can apply for an exemption for

• Deviation from storage regulations
• Permanent wearing of personal protective equipment (PPE)
• Exceptions to set deadlines
• And others

The following points must be explained to the competent authority:

• The reason for the exemption
• quantity of hazardous substance used annually
• Activities and procedures
• Number of employees affected
• Protective measures (incl. technical and organisational measures to reduce or prevent exposure)

• The deviation from the law that you are requesting must be compatible with the protection of the persons employed.
• There is a disproportionate hardship.

• You must apply for an official exemption by e-mail or post to the competent authority.
• You submit the required information to the competent authority.
• The competent authority will check your details and provide you with feedback.
