Public appointment of samplers pursuant to section 36 of the Gewerbeordnung (GewO)
With a public appointment as a sampler, you are available to courts, authorities, industry and the general public as a particularly reliable, credible and experienced person.
- As a sampler, you check the quality, quantity, weight or correct packaging of goods in production and in trade.
If you can demonstrate special expertise, personal suitability and the necessary independence, you can be publicly appointed and sworn in. - This means that you are subject to additional professional and objectivity obligations.
- Public appointment is a special public seal of quality for experts in Germany. There is no higher qualification in the field of expert activities.
- The contact details of publicly appointed and sworn experts are published in standardised directories.
- The designation "öffentlich-bestellt und vereidigt" (publicly appointed and sworn) is legally protected.
Note: In addition to all chambers of industry and commerce, in some federal states other professional chambers such as chambers of engineers, architects, chambers of agriculture and other state bodies are also authorised to make public appointments.

- Through training and further education as well as professional experience, you have acquired a level of expertise that is well above average.
- You have also already provided expert services in your field for several years.
- You are mentally and physically able to fulfil the requirements for experts in your field.
- There must be no reason to doubt your independence and objectivity. You live in orderly financial circumstances. You are impartial and independent.
- Further requirements are set out in the expert regulations of the relevant chamber and the appointment requirements for your area of expertise.
The fees vary depending on the chamber.
- Fee range: EUR 500.00 - 3,500
- Expenses for specialised committees and information: EUR 1,000 - 2,000
The procedure is very complex and varies slightly depending on the subject area. It is advisable to seek personal advice from the relevant chamber before submitting your application.
- The application form must be completed in full, signed and submitted with all the required attachments.
- You must apply for the certificate of good conduct for submission to an authority in accordance with § 30 Para. 5 BZRG at your Meldebehörde (registration office).
- The Chamber will request advance payments for fees and expenses.
- The Industrie- und Handelskammer will check the documents you submit for completeness and compliance with the minimum formal requirements.
- Your personal suitability will be assessed in a personal interview after analysing the references submitted. If necessary, other committees or bodies will be involved.
- The Chamber commissions independent experts to assess your expertise. For this purpose, the expert reports and work samples you submit will be reviewed. Depending on the area of expertise, there is also a written examination and a technical discussion or a practical examination.
- The IHK then makes the final decision, taking into account the professional assessment.
- Public appointment and swearing-in is limited in time in accordance with the expert regulations, for a maximum of five years.
- Upon application, an appointment can be renewed if the applicant can again prove their personal suitability and special expertise.
