Appointment of Animal Welfare Officers according to § 10 Animal Welfare Act (TierSchG)

Before commencing the activities listed below, the body responsible for the establishment or the person responsible for the establishment must appoint one or more animal welfare officers and notify the competent authority of the appointment:

• Vertebrate animals or cephalopods are bred, kept or used which are intended to be used in animal experiments,

Note: The interventions or treatments that fall under "animal experimentation" are defined in § 7 Absatz 2 Tierschutzgesetz

• vertebrate animals or cephalopods are bred, kept or used whose organs or tissues are intended to be used for scientific purposes;
• vertebrate animals are killed in order to use their organs or tissues for scientific purposes;
• the removal, in whole or in part, of organs or tissues from living vertebrate animals for the purpose of transplantation, culture or examination of isolated organs, tissues or cells for purposes other than scientific research.

  • Acquisition of appropriate knowledge and skills in the field of laboratory animals
• Information on the position (freedom from instructions) and powers of the animal welfare officer

Note: For documents in foreign languages, a copy in the original language and a copy of a German translation are required. Translations must be made by a publicly appointed or sworn interpreter or translator.

Personal requirements

The animal welfare officer

• is not subject to directives in the performance of his/her duties,
• has a university degree in veterinary medicine (exceptions may be permitted in individual cases),
• is not at the same time responsible for keeping or breeding animals in the facility (exceptions may be permitted in individual cases),
• possesses the knowledge and skills required to carry out the tasks,
• has the necessary reliability for this purpose, and
• may not at the same time be responsible for animal experiments which he himself carries out.

Mandatory tasks

The animal welfare officer is obliged to

• to ensure compliance with regulations, conditions and requirements in the interest of animal welfare,
• to advise the establishment or enterprise and the persons involved in the keeping of the animals, in particular with regard to the welfare of the animals during acquisition, accommodation and care, as well as with regard to their medical treatment,
• to give an opinion on any application for (simplified) authorisation of an experimental project,
• to work internally towards compliance with, promotion and continuous optimisation of the implementation of the 3R principles (Refinement, Replacement, Reduction) and to advise the persons involved in the performance of animal experiments in this respect, and
• to keep abreast of technical and scientific developments relevant to his area of responsibility through regular further training and to pass on his knowledge on an ongoing basis to the persons involved in the performance of animal experiments.

Appointment

Before commencing the activities concerned, determine the persons to be engaged as animal welfare officers.

• The position and powers of the animal welfare officer shall be regulated by statutes, internal instructions or in a similar form.
• If several animal welfare officers are appointed, their areas of responsibility shall be defined.

Notification

As the person authorised to represent the establishment, inform the higher animal welfare authority in writing which persons have been appointed as animal welfare officers.
