The public authentication of your signature can increase the acceptance of a power of attorney granted by you. You can have your health care proxy and your care directive certified by the locally competent care authority (Betreuungsbehörde).
Official certification is required if the authorised representative is to make declarations to the land registry and his or her power of attorney has not already been certified by a notary. A publicly certified power of attorney is also necessary if a declaration of inheritance is to be made on your behalf - for example, due to overindebtedness of the estate. The certification of the signature under the power of attorney is also required if the authorised representative is to be entitled to register or deregister you at the registration office.
However, public certification cannot replace notarial certification in all cases. A notarial certification may exceptionally be required if the power of attorney is also to irrevocably authorise the purchase or sale of real estate or flats or to take out consumer loans.
Tip: In the case of very complicated legal matters, involve a notary public who can also carry out the certification as an alternative to the guardianship authority; if necessary, seek legal advice.
- Original letter of attorney for health care / care directive
- Identity card or passport
Visit the guardianship authority in person with the health care proxy / care directive and your personal document.
- In the presence of the official ("certifying person"), you sign the documents to be signed with your own hand.
- The certifying officer compares the identity and signature and affixes a certification mark and the official seal to the documents.
