Have you noticed that Saxon authorities, companies or organisations are not managing your data carefully or are processing your data without your knowledge? Or you are not receiving any information about the data stored about you? In such cases, you have the right to lodge a data protection complaint.
The Saxon Data Protection and Transparency Officer is responsible for data protection for
- public bodies: Saxon state and local authorities, hospitals, schools, police stations, savings banks, chambers, notaries, et cetera
- non-public bodies: Companies, associations, private foundations et cetera with headquarters in Saxony
Documents that facilitate verification or prove the alleged data protection breach (recommended)
You feel that your fundamental right to informational self-determination has been violated.
Submit your complaint in writing - either by online form (see -> Online application), e-mail or letter. Describe the facts of the case in your complaint and observe the following instructions:
- A clear and precise description of the facts is required to process the case, including suitable attachments if necessary. You should submit any missing documents to the Saxon Data Protection Officer quickly and without being asked.
- Name the person responsible from your point of view
- Explain clearly that the organisation you are complaining about is processing your personal data in such a way that your rights are being violated.
- Complaints that do not involve you personally will be processed as a control request for which you will not receive any further information about the procedure.
- In the case of complaints, it may be unavoidable to disclose your identity in order to clarify the facts of the case. You should therefore indicate to the Saxon Data Protection and Transparency Officer whether you agree to your identity being disclosed to the controller - the data processing organisation.
- If you feel that your rights have been violated, you must provide your full name and postal address to the Saxon Data Protection and Transparency Officer. Without this data, your petition can only be processed as a control request, so you will not receive any further information on this process.
- It is advantageous if you also provide your telephone contact details in case of any queries or comments. Your request can then be processed more effectively. Your telephone number will only be used internally by the authorities for queries and is voluntary.
Following your notification, the Saxon Data Protection and Transparency Officer will investigate your complaint or inspection suggestion, clarify the facts of the case and make use of its powers vis-à-vis the controller at its own discretion. This includes, for example, imposing a temporary or permanent restriction on processing, including a ban. In addition, a fine may be imposed under certain circumstances - except against public authorities.
You will be informed of the result of the review in the event of a complaint.
