Notification of a public lottery or draw in accordance with Item II Number 1 of the General Permit for Small Lotteries and Draws in the Free State of Saxony (AELott)
You only need to notify the competent authority of a small lottery or draw (including a tombola). If the relevant requirements are met (see below), permission to hold the event in accordance with the General Permit for Small Lotteries and Raffles in the Free State of Saxony (Allgemeine Erlaubnis für Kleine Lotterien und Ausspielungen im Freistaat Sachsen - AELott) is deemed to have been granted upon notification; you will not receive a separate notification.
If a local authority acts as an organiser and the requirements of the AELott are fulfilled, the event must also only be notified to the Saxony State Directorate, Leipzig Office (upper gaming supervisory authority).
Regional authorities, commercial enterprises, commercial associations and commercial operators at their registered offices or at the registered offices of branch offices may only organise a small lottery or draw in accordance with the requirements of the General Licence for Small Lotteries and Draws in the Free State of Saxony (AELott). As a rule, a permit under gambling law cannot be granted to territorial authorities, commercial associations and tradesmen, as the prerequisite for the granting of an individual permit is recognised non-profit status (Section 14 (1) no. 1 GlüStV 2021).

The General Permit for Small Lotteries and Raffles in the Free State of Saxony (AELott) applies to events that meet the following requirements:
- The event does not extend beyond the territory of a district or an independent city.
- The net proceeds (total value of the tickets minus the costs incurred by the lottery) amount to at least one third of the fees to be paid for the purchase of all tickets.
- The sum of the winnings in lotteries or the value of the prizes in kind or other pecuniary advantages in lotteries shall amount to at least 25 per cent of the fees.
- The proceeds from the sale of all tickets shall not exceed EUR 40,000.
- The ticket sale shall not last longer than three months.
- The net proceeds shall be used exclusively and directly for charitable, church or benevolent purposes.
- At least 30 percent of the net proceeds must be used promptly in the territory of the Free State of Saxony.
Attention! If one point of the requirements is not fulfilled, you must apply for the lottery or draw at the Saxony State Directorate, Leipzig office.
- Request the officially prescribed form from the competent authority; depending on what the authority offers, you can also obtain it as an online form on the internet.
- Submit the completed form with all required documents to the competent authority.
- After the lottery or draw has been completed, submit proof of use to the competent authority, showing that the net proceeds have been used for charitable purposes. Alternatively, the competent authority may require the submission of confirmation from the tax office of exemption from lottery tax.
Notice:
- If the requirements are met, the event is considered approved and no separate official notice is issued.
- Do not forget to also notify the Chemnitz-Mitte tax office of the lottery or draw at least five days before the start of sales.
- Notification of the lottery or draw: no later than five days before the start of sales
- Registration with the tax office: at the latest five days before the start of sales
