Application for benefits of basic security in old age and in case of reduced earning capacity according to §§ 41 ff. Twelfth Book of the Social Code (SGB XII) - social assistance
Anyone who is permanently fully incapacitated for health reasons or due to a disability can receive social assistance in the form of so-called basic security in old age and reduced earning capacity.
If the persons concerned live in a nursing home or a so-called special form of housing (for disabled persons), they receive an amount for the costs of accommodation and heating as well as other living expenses for their stay there.
Scope of the basic income support
Basic income support in old age and in the event of reduced earning capacity is intended to ensure the necessary subsistence. This applies in particular to the costs of food, clothing, personal hygiene, household goods, heating and personal needs of daily life, such as telephone, newspaper or going to a concert (standard needs) as well as the costs of accommodation and heating.
In the case of accommodation in an inpatient facility (home) or in a special form of housing, there is an entitlement to the granting of the standard need as well as the average warm rent of a one-person household in the respective area of responsibility.
The amount of the benefit depends on the level of need. Personal income and assets are taken into account in the calculation.
Contact
For persons entitled to benefits from 18 to below the standard age limit who live in a nursing home, the Kommunaler Sozialverband Sachsen (KSV Sachsen) is responsible. For persons entitled to benefits who live in a special form of housing, the KSV Sachsen is always responsible, i.e. without age restriction.
The information in the application must be substantiated, for example by proof of costs, income and assets as well as medical certificates. You can find out which evidence is required in detail in the information sheets that you will receive when submitting your application.
An entitlement exists if the person concerned
- has his or her habitual residence in the Federal Republic of Germany and
- after reaching the age of 18, is unable to work at least three hours a day for the foreseeable future for health reasons or due to a disability, and
- has not yet reached the age limit (65 years and older, depending on the individual case) (otherwise the social welfare office is responsible)
Indigence
The persons concerned must be needy, i.e. their income and assets (or those of their spouse/cohabitant) are not sufficient to ensure their necessary subsistence.
If the persons in need of assistance have parents or children who are liable to pay maintenance, they are only included if their annual income exceeds EUR 100,000.
Application
In order to receive benefits from the basic income support in old age and in case of reduced earning capacity, you as the person concerned or his/her legal representative must submit a written application.
- You can obtain the application forms on site at the KSV or (if offered by the locally competent office) online under -> Forms & Online Services.
- You submit the completed application together with the required evidence to the KSV.
- You will receive written notification as to whether and to what extent the application has been approved.
Examination of incapacity for work
If it needs to be clarified whether you are incapable of working, the competent office will contact the pension insurance institution.
The examination by the pension insurance institution does not apply if the persons concerned already receive a pension for reduced earning capacity or are admitted to a workshop or other institution for disabled persons.
Broadcasting fee
If you receive certain state social benefits, for example basic income support, you can apply to be exempted from the broadcasting contribution.
