A European Cooperative Society (SCE) with its main establishment in another member state of the European Union has the option of establishing a branch in Germany. It must be entered in the German register of co-operatives

The entry is made by a notary at the register court in whose district the branch office is established.

It is also necessary to register a business for the branch office with the trade office of the respective city or municipality.

Changes to the SCE branch office, such as the address or authorised representatives, must be reported immediately in the same way for entry in the register.

If the register court refuses to enter a second branch of your European Cooperative in Germany in the register of cooperatives, an appeal may be lodged pursuant to Section 382 (4) sentence 2 FamFG in accordance with Section 58 (1) FamFG or, if applicable, an appeal on points of law pursuant to Section 70 (1) FamFG.
