A cooperative must be entered in the register of cooperatives. Registration must be made by all members of the Executive Board. Registration by a proxy or authorised representative is excluded.

You can use the service of the single point of contact for this procedure. This person will guide you through the procedure, take care of correspondence with all the bodies responsible for your request and provide you with expert advice.

- Articles of Association, signed by the members
- Copy of the deeds of appointment of the Management Board and the Supervisory Board
- Certificate from an auditing association authorising the accession of the cooperative as well as an expert opinion from this association on the possible risk to the interests of members or creditors
Please also state in the registration form what power of representation the members of the Management Board have.
- The amount of the fee for the entry is determined in accordance with the German Court and Notary Fees Act in conjunction with the Ordinance on Fees in Commercial, Partnership and Cooperative Register Matters.
- In addition, expenses are incurred for the public announcement of the entry.
Application
To apply, contact a notary.
- The notary will advise you on how to formulate the application.
- The application is made exclusively electronically and a publicly notarised document is created for this purpose. From 1 August 2022, the document can also be notarised via video communication.
- The declaration is provided with an electronic signature and sent to the electronic court and administrative mailbox of the registry court.
You will receive a notification that the entry has been made.
Changes
Have important details about your cooperative, such as the registered office, branch office or authorised representatives, changed? Then have the register entry corrected immediately.
The entry is made in the same way exclusively via a notary.
If the register court refuses to enter your cooperative in the register of cooperatives, an appeal may be lodged in accordance with Section 382 (4) sentence 2 FamFG pursuant to Section 58 (1) FamFG or, if applicable, an appeal on points of law pursuant to Section 70 (1) FamFG.
