Permission to buy and sell substances and mixtures for restoration and maintenance work according to § 3 ChemVOCFarbV

Paints and varnishes for coating buildings, components and building elements or products for vehicle refinishing may be placed on the market for the purpose of certain restoration and maintenance work, even if they do not comply with the limit values for volatile organic compounds.

Permission to buy and sell such substances and preparations must be applied for from the competent authority.

Attention! Both buyers and sellers of the product must apply for a permit. Different authorities may be responsible for this.

The limits for the maximum content of volatile organic compounds (VOC) in products are regulated by the Chemicals Ordinance on the Limitation of VOC Emissions (Solvent-Based Paints and Varnishes Ordinance - ChemVOCFarbV).

Single point of contact

For this procedure, you can make use of the service of the Single Point of Contact. This person will accompany you through the procedure, take care of the correspondence with all the offices responsible for your concern and will be at your side as a competent advisor.

The application must contain the following information:

• Details of the restoration and maintenance work required
• Information on the ready-to-use product to be purchased/sold for these purposes (including safety data sheet) as well as information on the product category
• Indication of the quantities of the product required for the restoration/maintenance work
• Proof that no low-solvent product is suitable for the purpose
• Proof that the building or vintage vehicle is classified as being of special historical and cultural value

The products concerned (paints and varnishes and vehicle refinishing products) must be used for the following purposes:

• for the restoration and maintenance of buildings, their components and decorative building elements
• for the restoration and maintenance of vintage vehicles which are classified as being of particular historical and cultural value

The competent authority shall check the completeness and correctness of the application documents and, provided that all requirements are met, shall grant the permit. If necessary, it may request additional documents.

• Processing time of the competent authority: maximum three months

Note: The processing time begins with the receipt of the complete documents. The deadline can be extended once by the authority with justification if there is a justified need for this. For this reason, it is advisable to submit the application in good time before the date of execution of the planned restoration or maintenance work.
