You must notify the relevant authorities in advance of any work that reaches into the groundwater, such as the construction of wells and other drilling work into the groundwater.
Drilling and trenching work that does not reach the groundwater, such as foundation drilling or trenching for infiltration investigations, must also be notified. There are no exceptions with regard to depth, as even shallow boreholes can provide important geological findings on the one hand, but can also contain potential hazards on the other.
Retain drilling samples
Drilling samples and other observation material must be taken and stored in accordance with certain specifications and offered to the Saxon State Office for the Environment, Agriculture and Geology (Sächsisches Landesamt für Umwelt, Landwirtschaft und Geologie) and the responsible lower water authority (at the municipal administration or district office) and presented on request.

Please contact the Saxon Upper Mining Authority or the lower water authorities to find out what fees they may charge.
Please use the online procedure ELBA.SAX (online application / forms) to submit your drilling notification.
- Your notification will be forwarded via the online portal to the lower water authority, the State Office for the Environment, Agriculture and Geology (Sächsisches Landesamt für Umwelt, Landwirtschaft und Geologie)and, if applicable, to the Saxon Mining Authority (responsible, among other things, for boreholes that reach deeper than 100 metres underground). This means that you only have to submit the notification once and not individually to the various authorities.
- As a rule, you will receive the letters from the authorities electronically via the online portal ELBA.SAX to the e-mail address provided, in some cases also by post.
Note: If you commission well builders or a geological engineering firm, they will in most cases make the necessary notifications to the authorities for you.
- Drilling notification: at least one month before the start of work
- Commencement of work: after receipt of the corresponding decision from the lower water authority.
Note: If you have not received a response to your notification one month after receipt of the confirmation letter and you are not drilling deeper than 100 metres, you may start drilling from a water, mining and geological law perspective.
- Notification of the drilling results after completion of the drilling work:
- Technical data no later than one month,
- Assessment data no later than six months (observe any different deadlines in accordance with the Geological Data Act)
