Recognition as another person according to § 13 under the MarkschBergV (Mine Surveyor Ordinance)

Certain activities are reserved for recognised mine surveyors by law. If you wish to carry out restricted mine surveying activities, you must apply for recognition as an "other person".

The activities that may only be carried out by recognised mine surveyors include, for example

• Leading the crack work of mining operations
• Drawing up bearing cracks for mine property
• Determining a new angle of influence of underground mining operations

For the management of mine workings where the mine drawing is not required, persons with a university degree in mine surveying or surveying technology or other surveyors who fulfil the requirements mentioned below may be recognised as "other persons" (see "legal basis") upon application.

Important! Recognition is granted once by a federal state. It is only necessary to notify the competent mining authority of the acceptance of the work for each mining operation.

Single point of contact

For this procedure you can use the services of the Single Point of Contact. He or she will accompany you through the procedure, take care of the correspondence with all the authorities responsible for your matter and will be at your side as a competent advisor.

• Curriculum vitae
• Proof of completion of the required training (e.g. certificates or diplomas in the original or as certified copies)
• Evidence of the type and duration of the subject-specific professional activity following the professional qualification

The applicant must

• be physically fit and there must be no facts that make him/her appear unreliable for the activity,
• demonstrate the required knowledge and skills for the activity.

The applicant can meet these requirements by providing evidence of at least three years of specialist professional activity in the mining sector for which he or she wishes to apply for recognition. This includes

• a final examination recognised in the European Union, a contracting state of the European Economic Area or Switzerland in a subject related to mine surveying or surveying technology at a university, technical university, technical college or technical college,
• a professional qualification recognised as equivalent abroad, or
• a vocational training recognised as equivalent in another way with above-average technical knowledge

Note: Physically or mentally unfit is, for example, someone who is permanently incapable of performing the work of a mine surveyor due to a physical infirmity or a physical or mental weakness.

Costs of proceedings: EUR 45.00 to EUR 170.00

Attention! If you have acquired the prerequisites for recognition outside the Federal Republic of Germany and therefore an additional examination effort is required, an additional fee will be charged for the time spent on the examination.

• You must apply in writing for recognition as an "other person".
• The application will be examined at the Saxon Upper Mining Office. Provided that you can prove the necessary personal requirements including the required technical knowledge (if necessary in a personal interview at the Saxon Upper Mining Office), the recognition as another person for the crack work management can take place.
• You will receive a written decision as a certificate.

The keeping of the crack work as a recognised other person for a mining operation requires the exemption from the requirement of the mine map for this operation. (§ 12 MarkschBergV)
