- § 979 Bürgerliches Gesetzbuch (BGB) – Verwertung; Verordnungsermächtigung
As a rule, lost property can be auctioned off at the earliest after the statutory storage period of six months has expired. However, if safekeeping would involve disproportionate effort and expense, a lost property may be auctioned off sooner. At the end of the safekeeping period, the lost property is sorted out by the lost property office. Only items that are in good condition and can be further used will be retained for auction.
Finders who have asserted their claim to ownership at the time of delivery of the lost property will be informed in writing by the lost property office that their find is ready for auction, unless they have already come in person. The lost property will be handed over against payment of a small fee for the administrative costs incurred.
All other lost property will be destroyed or donated to charitable purposes.
Public auctions
As a rule, these auctions are held quarterly. The dates are set and published at the beginning of the year for the whole year. In addition, each event is announced individually in the official gazette and in the daily press before it takes place.
During the public auctions, only cash payment is accepted.
Internet auctions
The lost property office also auctions individual lost property items on the internet via the customs auction platform.
There are no specific dates for this. The items offered at the customs auction are illustrated and described. Interested parties can inspect the items in person during the office hours of the lost property office. It is also recommended, as the purchase of a lost property item via the internet auction excludes any warranty of the bidder for material defects.
The bids will not be sent out after the award of the contract, but are to be collected against cash payment and during office hours at the lost property office.
Lost property that has not been collected after the storage period has expired and is in good condition will be put up for auction. You then have the opportunity to purchase these valuables at public auctions or internet auctions. It is recommended that you take a close look at the lost property in advance of the auction.
If you have purchased a valuable item at a public auction, you pay on the spot and can take the valuable item with you immediately.
If you bought a valuable item at an auction on the internet, it will not necessarily be sent and you can collect and pay for the item during the opening hours of the lost property office.
Please note that the amount must be paid in cash.
