- § 39 Sozialgesetzbuch, Achtes Buch (SGB VIII) – Leistungen zum Unterhalt des Kindes oder des Jugendlichen
If the child lives in a foster family, the youth welfare office has to ensure the necessary maintenance of the child. This is done by paying a monthly lump sum.
Foster care allowance
In addition to the material maintenance payments, the foster care allowance includes an amount for the costs of upbringing, which is granted as compensation for the upbringing services rendered.
If the child is with grandparents who are liable to pay maintenance, the lump sum can be reduced.
In Saxony, the amount of the care allowance is determined by the Land Youth Welfare Office (Landesjugendamt) as the competent authority. The lump sums are usually adjusted annually. The assessment basis is the annually recommended lump sums of the German Association for Public and Private Welfare (Deutscher Verein für öffentliche und private Fürsorge e.V.).
Year 2023
in 2023, foster care allowance is to be granted in the following amounts, depending on the age group:
Age of the foster child
- from 0 to under 6 years
- Material expenses: EUR 639.00*
- Care and education: EUR 275.00
- from 6 to under 12 years
- Material expenses: EUR 783.00*
- Care and education: EUR 275.00
- from 12 to under 18 years
- Material expenses: EUR 919.00*
- Care and education: EUR 275.00
*) For material expenses, the share for child-related costs for rent and heating (gross warm rent) for all age groups is EUR 142.94. There is no further breakdown of costs for material expenses.
Note: The German Association also points out that an adjustment of the benefits may be necessary if the lump sum is not sufficient for the foster child according to the particularities of the individual case. This may be the case in particular if the foster person is one of the beneficiaries of SGB II and, according to the case law of the Federal Social Court, the division of accommodation and heating costs is carried out according to head shares of all persons living in the household, although foster children who are not beneficiaries of SGB II live in the household.
One-off allowances and grants
In addition to the monthly foster care allowance, it is possible to apply for one-time allowances or grants - for example, for the initial equipment of the foster family, important personal occasions or holidays and holiday trips of the foster child.
Contributions to accident and pension insurance
The foster care allowance also includes a claim for reimbursement of proven expenses for contributions to accident insurance as well as half of the reimbursement of proven expenses for adequate old-age provision. The reimbursement is to be granted in a monthly lump sum.
Before foster parents conclude a corresponding insurance contract, they should in any case talk to their responsible youth welfare office.
The expenses proven by foster parents to the youth welfare office are to be reimbursed as a lump sum and their assumption is to be determined in a written decision.
The child or young person lives with you as a foster child due to a decision by the youth welfare office.
- After you have taken the child into your family, you will receive the monthly lump-sum care allowance from the Youth Welfare Office in the amount mentioned above.
- An application is not required.
- The maintenance payments are made as long as the child is in full-time care.
