Proof of expertise for placing on the market and supplying certain substances, mixtures and products by taking the expertise test in accordance with the Chemicals Prohibition Ordinance
As a manufacturer, importer or distributor, you may only supply certain substances or substance mixtures or make them available to third parties with official authorisation. The prerequisite for the granting of a licence is expertise in accordance with the Chemicals Prohibition Ordinance (ChemVerbotsV), which you acquire through a corresponding qualification or by passing an examination of expertise.
The placing on the market and the supply of substances or mixtures of substances as defined in Annex 2 of the Chemicals Prohibition Ordinance (ChemVerbotsV) requires a licence:
Requirements for the granting of a licence according to § 6 ChemVerbotsV:
- Proof of expertise according to § 11 paragraph 1 ChemVerbotsV depending on the type of substance by
- Qualification according to § 11 paragraph 3 ChemVerbotsV or
- Examination of expertise by the competent authority (Saxony State Directorate) or an institution recognised by it (Section 11 (2) ChemVerbotsV)
- required reliability
- Minimum age: 18 years
Obligation to notify when taking up the activity according to §7 ChemVerbotsV:
If you supply such substances exclusively to resellers, professional users or public research, testing or teaching institutions, you do not require a licence. However, you must notify the competent authority in writing of the first-time commencement of supply, unless you are otherwise qualified in accordance with Section 11(1)(1) in conjunction with (3) ChemVerbotsV.
Types of expertise:
- comprehensive expertise
- limited expertise for plant protection products and biocides
- limited expertise with the exception of plant protection products and biocides
- Expertise for individual hazardous substances and mixtures
for examinations by the State Directorate of Saxony:
- comprehensive examination of expertise: EUR 190.00
- limited examination of expertise: EUR 115.00 to 135.00
- Acceptance of a limited examination: EUR 90.00
In the Free State of Saxony, you can take the examination of expertise at the Saxony State Directorate.

- Enter the desired examination date and tick the type of examination.
- Send the signed application form by post or e-mail(Arbeitsschutz@lds.sachsen.de) to the relevant office.
- You will promptly receive an invitation to the examination or, if the maximum number of participants is exceeded, an offer of an alternative date.
- Please bring an official identification document (identity card or passport) with you on the day of the examination.
Expertise test
The examination covers general knowledge of the essential properties of the substances and mixtures listed in Annex 2 of the Ordinance, the hazards associated with their use and knowledge of the relevant legal provisions.
The examination of expertise is based on the "Bekanntmachungen - Hinweise und Empfehlungen zum Sachkundenachweis gemäß § 11 der ChemVerbotsV" of the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety.
Depending on the type of expertise, the examination contains 30 to 60 questions, each with 4 possible answers (multiple-choice procedure). After passing the exam, you will receive a certificate.
