Notification and transmission obligations for substances that are undesirable in terms of health (Notification and Transmission Ordinance - MitÜbermitV)
Food and feed business operators are obliged to notify the competent authorities of any test results on dioxins, dioxin-like and non-dioxin-like polychlorinated biphenyls. Dioxins and polychlorinated biphenyls are highly toxic chemical compounds. They are mainly ingested via animal foodstuffs and can be dangerous even in low concentrations.
It is not only maximum levels that must be reported, but also all test results for the substances listed in Section 1 of the Notification and Transmission Ordinance.
The following materials and substances must be reported to the competent authorities:
- Congeners (chemical compounds) of dibenzo-p-dioxins and dibenzofurans and congeners no. 1 - 17 in accordance with Annex 1 MitÜbermitV
- Congeners of dioxin-like polychlorinated biphenyls and the congeners under No. 1 - 12 according to Annex 2 MitÜbermitV
- Congeners of non-dioxin-like polychlorinated biphenyls and the congeners under No. 1 - 6 in accordance with Annex 3 MitÜbermitV
If the test has been carried out using a test method that cannot be used to determine the above congeners, the notification obligation only applies to dibenzo-p-dioxins, dibenzofurans and dioxin-like polychlorinated biphenyls as a group of substances.

You can download the sample files for the notifications from the website of the Federal Office of Consumer Protection and Food Safety (BVL) on dioxins and other persistent organic compounds.
- The notification must be made in electronic form and contain all data in accordance with Annex 4 of the MitÜbermitV.
- Electronic templates in Excel format must be used for the notifications. The electronic templates to be used in accordance with the MitÜbermitV are provided by the competent authorities of the federal states (see competent authority) or linked to the website of the Federal Office of Consumer Protection and Food Safety (BVL). There you will find a sample of such a digital registration file for both food and feed to make your work easier.
- The format must not be changed.
- In the food sector, please follow the instructions of the responsible food monitoring and veterinary office.
- For notifications from feed companies, please follow the link on the website of the Saxony State Research Centre in the "Official Feed Monitoring" section.
- This data is transmitted anonymised by the competent authorities to the Federal Office of Consumer Protection and Food Safety (BVL).
- The BVL uses this data to compile its quarterly report on the levels of undesirable substances in or on food or feed.
Important: If it is not possible to process Excel documents for technical software reasons, you can agree a different, preferably Excel-compatible format for data exchange with the responsible food monitoring and veterinary office/feedstuffs division of the Saxony State Research Centre.
- The notification must be submitted within 14 days of the entrepreneur becoming aware of the test result.
Note: This is only the case when the test result has been finalised.
- The notification must be submitted immediately if a maximum level has been exceeded that is specified in the German Food and Feed Code (LFGB), a regulation issued on the basis of the LFGB or in a directly applicable legal act of the European Community or the European Union.
