Application for recognition as a mine surveyor in accordance with § 64 of the Federal Mining Act (BBergG) / Examination of the equivalence of a foreign professional qualification

If you wish to carry out activities in Saxony that are reserved for mine surveyors under the Federal Mining Act (BBergG) or other legal provisions, you must apply for recognition as a mine surveyor. If you have a corresponding foreign professional qualification, you must have it checked whether it meets the requirements for recognition.

The activities of a mine surveyor include, for example

  • Managing the mine workings of mining companies
  • Drawing up bearing plans for mine property
  • Proof of the boundary of an impact area by measurements

Anyone who is already recognised as a mine surveyor in another state of the Federal Republic of Germany and has not yet reached the age of 70 does not require recognition.

Note: The Saxon Upper Mining Authority keeps a publicly accessible register with the names and addresses of the branches of the recognised mine surveyors.

You can use the services of the Single Point of Contact for this procedure. This person will accompany you through the procedure, take care of the correspondence with all the offices responsible for your request and will be at your side as a competent advisor.

Erforderliche Unterlagen

  • Curriculum vitae
  • Proof of the required qualification for the higher civil service in the field of mine surveying
  • medical certificate from a public health officer
  • Declaration that a certificate of good conduct has been applied for at the registration office for submission to the competent authority
  • Declaration of the existing or intended place of establishment with all branch and satellite offices
  • Declaration as to whether recognition as a mine surveyor already exists in another federal state or whether an application for recognition has been filed

Under certain circumstances, the Saxon Upper Mining Authority may exempt you from submitting certain documents.

for the determination of the equivalence of a foreign professional qualification:

  • Tabular presentation of the school and vocational training and the professional activities carried out (in German)
  • Proof of identity (officially certified copy of identity document, certificate according to the Federal Expellees Act or registration certificate, if applicable, proof of a change of name)
  • the educational certificates acquired abroad and the corresponding enclosures (officially certified copies)
  • german translations of the respective educational certificates
  • Proofs of relevant professional experience and certificates of competence (as well as their German translations)
  • Declaration as to whether, with which body and with what result an application for recognition of the professional qualification has already been submitted
  • Certificate of authorisation to practise the profession, if the profession is also regulated in your country of training.

Translations must be done by a publicly appointed and sworn interpreter or translator (see Amt24 procedure description).

Voraussetzungen

  • Qualification for higher civil service in the field of mine surveying (in particular, passing of the Grand State Examination in Mine Surveying) or recognition of the equivalence of a foreign professional qualification
  • the reliability required for the activity and
  • the physical and mental aptitude required for the activity

The required reliability is not given in particular if

  • You do not possess the ability to hold public office,
  • You have been removed from office as a civil servant in accordance with disciplinary regulations or your pension has been withdrawn as a retired civil servant,
  • You have left an employment relationship for a reason that would lead to removal from employment in the public service,
  • You are restricted in the disposal of your assets by court order, or
  • You are permanently incapable of carrying out the duties of a mine surveyor due to a physical infirmity or a physical or mental weakness.

Kosten

  • Procedure fee: EUR 50.00 to EUR 202.00

Examination / recognition of a foreign professional qualification

  • Procedural fee: EUR 20.00 to EUR 600.00 (depending on administrative costs)
  • if applicable, expenses, e.g. for certifications, authentications, translations or expert opinions
  • for persons entitled under the Federal Expellees Act: none

Verfahrensablauf

Submit a written application for recognition as a mine surveyor to the Saxon Upper Mining Authority. As an applicant with a foreign professional qualification, please also apply for recognition of the equivalence of your professional qualification.

You will receive a certificate of recognition. The recognition becomes effective when the certificate is handed over.

  • Application deadline: none
  • Free of charge for persons entitled under the Federal Expellees Act: three years from the date of permanent residence in the Federal Republic of Germany

Attention! You have a duty to cooperate! If you disregard the deadlines that may be set for you during the processing of your application (for example, for the submission of additional documents), this may lead to a delay or the discontinuation of the procedure.

Lapse of recognition

Mine surveying activities that are reserved for mine surveyors under the BBergG may only be carried out up to the age of 70. Thereafter, a recognition as mine surveyor granted by the Saxon Upper Mining Authority expires.

Recognition of a foreign professional qualification

The requirements for recognition are very complex and always depend on the individual case. Before submitting an application, take advantage of the free, confidential advice offered by the Saxony Labour Market Information and Advice Centre (IBAS) and the Saxon Upper Mining Authority.

Written application

To have your foreign professional qualification assessed and recognised, you must submit a written application. Please submit your application and the required documents exclusively in writing to the Saxon Upper Mining Authority ("Zuständige Stelle").

Electronic submission

Access for electronically signed or encrypted electronic documents is not possible. However, if you have acquired your professional qualifications in a member state of the EU or equivalent countries or if these qualifications have already been recognised in these countries, you can send your documents electronically via the Single Point of Contact of the Free State of Saxony.

Assessment

In the assessment procedure, a decision is made on the equivalence of your qualification.

  • The assessment is based on specified formal criteria, such as the content and duration of the training.
  • Your relevant professional experience is taken into account, as are other relevant qualifications.

You will receive written notification of the result. This also contains information on which qualifications you lack for full recognition. Recognition can be granted if you complete supplementary training and take an additional examination.

Appeal against the decision

  • You can lodge an objection against the decision issued by the competent authority within one month of its notification to the authority or file a complaint with the competent administrative court.
  • If necessary, you will be informed whether you can complete an adaptation period or a measure to determine your competences.
