Do you need information on whether insolvency proceedings have been opened against a company or a person or would you like to enquire about the status of ongoing proceedings? The courts publish notices of insolvency proceedings on the nationwide internet portal. The notices are accessible to everyone there for a limited period of time.
If you require further information, the insolvency court can provide you with information on request about
- insolvency proceedings that have been opened and cancelled
- Insolvency proceedings whose opening was rejected due to lack of assets
- insolvency applications filed by debtors
However, the right to information is limited. For example, the court may only inform you of a creditor's insolvency application if this is of particular interest to legal transactions (e.g. due to the ordering of provisional protective measures).
Inspection of files
If you yourself are involved in insolvency proceedings as a creditor or debtor, the competent insolvency court will allow you to inspect the files on request.
Information from the debtor register
Debtors are entered in a central debtor register,
- who have not fulfilled their obligation to submit a list of assets,
- for whom, according to the contents of the list of assets, full satisfaction of the creditor is not to be expected,
- who do not provide the bailiff with evidence of full satisfaction of the creditor within one month of submitting the list of assets, or
- for whom an application to open insolvency proceedings has been rejected due to lack of assets.
The central debtor register can only be accessed via the Internet.
Parties entitled to information
- Parties to the proceedings
- Third parties if there is a legal interest
Insolvency publications
In addition to general information on insolvency proceedings, the federal and state justice portal contains a nationwide directory of the locally competent courts.
Request for further information
You can apply informally to the competent insolvency court for more detailed information on individual insolvency proceedings. In addition to your request, state your legal interest in the information.
