Notification in accordance with Section 22 (2) of the Implementing Regulation for the Saxon Building Code (DVOSächsBO)

Persons who are established in another EU member state, another EEA contracting state or Switzerland for the performance of tasks that correspond to the Implementing Regulation for the Saxon Building Code (DVOSächsBO) are entitled, under certain conditions, to perform tasks as a test engineer for stability in accordance with the DVOSächsBO.The first-time activity must be notified in advance to the recognition authority.

A notification is not required if such a notification has already been made in another country of the Federal Republic of Germany.

The following information and evidence must be enclosed with the notification:

• Certificate stating that you are established in a Member State of the European Union, another State party to the Agreement on the European Economic Area or Switzerland for the purpose of performing tasks in accordance with the DVOSächsBO.
• Proof that you had to fulfill the requirements of § 22 Paragraph 2 Sentence 1 Number 2 DVOSächsBO in the country in which you are established.
• Proof of German language skills, both spoken and written, in the case of non-German-speaking foreigners
• Proof of liability insurance with a liability sum of at least EUR 500,000 each for personal injury as well as for property damage and financial loss per claim, which must be available at least twice in the insurance year; the insurance contract must refer to the activity as a test engineer for stability and cover claims in Germany

The above-mentioned persons may carry out tasks as test engineers for structural stability in accordance with the DVOSächsBO if they

• have a comparable authorization with regard to the field of activity,
• have had to fulfill comparable requirements with regard to the prerequisites for recognition and proof of knowledge, and
• are able to speak and write the German language

Issue of the confirmation: Fees according to time spent (EUR 67.00 per working hour or part thereof).

Note: The fees are also charged in case of prohibition of activity.

Notify the competent authority in an informal letter that you wish to act as a test engineer for stability for the first time.

Upon request, the authority will confirm that the notification has been made; it should prohibit the activity if the above requirements are not met.
