As the trademark owner, you can apply for the cancellation of your trademarks, for example if you no longer wish to utilise them commercially.
You can also have a trade mark only partially cancelled - i.e. only for some of the goods or services for which it is registered. The trade mark can still be used for the remaining goods or services after the cancellation procedure.
- Declare in writing to the Deutsches Patent- und Markenamt (German Patent- and Trade Mark Office, DPMA) that you surrender the trade mark concerned.
- Use the form provided for this purpose
A trade mark can also be cancelled at the request of a third party - opposition by a third party is possible within three months of publication of the registration.
In addition, the Deutsches Patent- und Markenamt (DPMA) is authorised to cancel a trade mark ex officio in special cases (example: absolute grounds for refusal exist).
